Role Summary

·To lead, build and develop on effective commercial team

·Direct and control of all ongoing commercial elements of the business to achieve set targets

·Obtain and manage via key contacts business development opportunities

·Maintain client contact throughout a project’s life cycle

·Ensure the business provides a unique service to key contacts, enabling further company success

·To provide accurate reporting in all commercial matters, as a fundamental business requirement

·Protect the company’s interests in all dealings

·Lead and promote and follow a strong team culture with open and transparent communication

·Direct and control the commercial team to ensure adequate resources are in place and in line with the company values and ethics

Main Duties & Responsibilities

·Direct and control all commercial and buying to ensure employees are motivated and trained and carry out their responsibilities to the required standard

·Contribute to the development of the company’s corporate strategy and lead strategy development in the areas of commercial and buying to ensure that the company achieves its short and long term objectives

·Develop and implement all necessary policies and procedures to ensure that the commercial and buying functions achieve their business objectives

·Develop for approval and control overhead budgets for commercial and buying departments to ensure that the department has all the resources required to meet the objectives within agreed financial parameters

·Ensure that all bids are submitted with a robust cost appraisal developed with a clear overhead and profit recovery strategy

·Direct and control the commercial function to ensure that all projects are delivered on time and to the required standards of quality and budget

·Direct and control project financial performance against agreed financial parameters, including any commercial action that may be required against any project shareholders. Any legal action against clients or consultants must be agreed with the Managing Director

Pre-construction

·Sign off all opportunities against target workload – in terms of turnover and commercial return

·In conjunction with Operations Director approve bid action plan for each project

·Attend adjudication meeting

·Sign off bid submissions from a commercial perspective, in terms of overhead and profit recovery, subcontractor packages, procurement and design risk

·Review and agree the wording of all Pre Construction Services Agreements.

·Direct and control the allocation of commercial staff to projects

·Sign off commercial strategy for the project

·Ensure letter of intent as a minimum (main contract is preferred) is in place prior to the commencement of any procurement or a start on site

·Review and agree the word of all Letters of Intent / Contract Documents.

·Direct commercial team to make sure contract amendments, payment terms retention/bond provisions protect the business

·Ensure suitable contractor proposals/employers requirements are in place to reduce the risk and align to our bid

·Sign off mobilisation stage to ensure we are significantly prepared to complete the project in line with contract requirements and our policies and procedures

Project Delivery

·Direct and control the allocation of resource to the commercial and buying team to ensure workload and capability from a commercial perspective

·Ensure that all commercial teams are in compliance with policies and procedures

·Attend client start up meetings

·Attend external progress meetings where appropriate to maintain key shareholder relationships

·Attend external progress meetings if there is a delay or have/potential to have a conflict with the client

·Ensure commercial input is given/incorporated into each monthly project report

·Direct and control commercial team to ensure monthly (contractual) applications are carried out in a timely manner and certificates are issued to Finance department

·Control commercial team to ensure monthly financial reviews CVR’s are carried out on all projects

·Attend and take minutes of monthly Senior Manager Project Reviews

·Control commercial team to ensure subcontractors are appointed on standard payment terms

·Ensure main contracts are entered into at the earliest possible opportunity and that contract amendments, payment terms, retention/bond provisions protect the business

·Where commercially viable direct and control the commercial team to ensure the timely settlement of the main contract and subcontracts

·Direct and control the buying department to ensure they are providing the adequate and timely support to the commercial and operations team

General

·Manage staff in line with Managers Handbook.

·Ensure the development and management of departmental procedures

·Attend sites on an adhoc basis to review progress, compliance against company policy and procedures and promote the company.

·Ensure commercial employees have adequate personal development plans to ensure they have the capability to match current policies and procedures and promote a culture of learning and continuous improvement

·Identify resource requirements and ensure recruitment is carried out in a timely manner in line with company procedures

·Ensure all team members get a 1-2-1 on a minimum bi-monthly basis

·Meet with the Finance Department lead on a weekly basis to update cashflow on a short, medium and long term basis.

Board

·Actively develop and contribute to the corporate strategy

·Attend Operations Board Meetings

·Specifically develop and manage the identification of corporate strategy as regards to pre-construction (commercial), project financial performance and supply chain

·Produce board papers on pre-construction in conjunction with Operations Director.
